About This Initiative
The 2027 Texas Light Trespass Initiative proposes two narrow statutory amendments to give property owners a legal remedy when a neighbor's excessive, unshielded outdoor lighting invades their land — a right Texas currently does not provide.
Health & Safety Code §343
Adds light trespass as a civil nuisance actionable in Texas courts.
Penal Code §42.01
Adds excessive unshielded lighting (≥2,000 lm at ≥2700K; ≥3,000 lm below 2700K) to disorderly conduct — only after formal notice.
